After investigation, Xinjiang Guanghui used the approved registration qualification to transfer its core business such as actual operation and management to affiliated companies that are not registered entities without the approval of the registration authority; xinjiang Guanghui has mixed personality with its affiliated companies in terms of organizational structure (company executives, staff, actual office space, contact information, etc.), financial management, business operation, club registration and access, etc; in the admission assessment documents submitted by Xinjiang Guanghui (2019-2020, 2020-2021 and 2021-2022 seasons), the documents named its affiliates were mixed; Xinjiang Guanghui did not employ coaches, the staff also failed to undertake the obligation to pay the athlete’s salary in accordance with the requirements of relevant laws and regulations.

Based on the above, Xinjiang Guanghui seriously violated China Basketball Association registration administer method, which constituted a registration violation. According to Articles 7, 59 and 69 of the discipline standards and punishment regulations of the Chinese Basketball Association and Article 165 of the registration administer method of the Chinese Basketball Association, Xinjiang Guanghui is punished as follows:

I. Give notice and criticism to Xinjiang Guanghui; Limit the registration of new athletes within one year from the date of the punishment decision, that is, within the aforementioned time limit, except for domestic athletes who have completed effective registration in the 2022-2023 season, they are not allowed to register other new domestic athletes (including pre-registered athletes), and are not allowed to participate in or conduct transfer exchanges between domestic athletes; II, xinjiang Guanghui made rectification during the same period to meet the requirements of China Basketball Association registration administer method and relevant management regulations.

At the same time, the investigation found that China Basketball Association (Beijing) Sports Co., Ltd. (hereinafter referred to as China Basketball Association) had financial transactions with Xinjiang Guanghui and its affiliated companies, and both parties violated the registration of China Basketball Association, the management system such as competition access and the CBA league competition right authorization agreement violate relevant financial and tax management regulations. Background:

On June 4, 2021, the athlete Zhou Qi filed an application for mediation with the Chinese Basketball Association company for the contract dispute with Xinjiang Guanghui. After the mediation, Zhou Qi refused to accept the mediation result and submission to arbitration to China Basketball Association on issues such as free agent identification, Xinjiang Guanghui competition subject, Labor tax calculation method, and whether China Basketball Association company violated regulations on August 23, 2021. China Basketball Association filed a case according to regulations.
